RIGHT OF RENUNCIATION

At the traveller's request, the execution of the contract shall begin immediately and the necessary reservations and confirmations shall be made immediately. In application of Article VI.53, 12° of the Code of Economic Law and its implementing decrees, the following applies: the consumer does NOT have the right to renounce the purchase.
 

Terms of sale Getflights BV as intermediary/broker

 

1. Agreement

Getflights BV acts as intermediary between the professional customer or consumer (‘Client’) and the performing Service Provider (Airline or other carrier) in the conclusion of a passenger/air transport agreement between the professional customer or consumer and the performing Service Provider, unless otherwise stipulated.

By means of a booking, through the intervention of Getflights BV, an agreement of passenger/air transport is established between the Customer and the performing Service Provider.
 

2. Price
 

The stated prices are set by the performing Service Provider or tour operators and remain valid while stocks of the product concerned last. Quotes and prices communicated verbally by Getflights BV always remain subject to change. For flights, the price is only final when the airline ticket is issued. Issue is only possible after full payment.

 

3. Liability

Getflights BV is explicitly not a party to the final agreement of passenger/air transport and therefore not liable for the execution of the transport or other possible booked services. Its obligation is limited to providing the legally required information and supplying tickets in the name and on behalf of the performing Service Provider, which only provide rights and obligations on behalf of the performing Service Provider and the traveller. These conditions and the conditions of the performing Service Provider, which may limit or exclude its liability, are both applicable. In particular, as regards timetables, it should be emphasised that: The stated timetables may change at any time, this both before and during the trip. Consequently, connecting flights cannot be guaranteed by Getflights BV. In particular, regarding cancellation and modification by the performing Service Provider or tour operator;

If, for any reason, one or more Performing Service Providers or tour operators decide to cancel or change all or part of the flights or trip, Getflights BV shall only be obliged to refund all or part of the airline ticket or trip, if it has itself obtained a refund from the Performing Service Provider or tour operators. Under no circumstances shall Getflights BV itself be obliged to refund the airline tickets or any other compensation.
 

4. Cancellation and modification by the traveller

In case of cancellation, the contractually agreed fees must be paid by the traveller in any case, even if the cancellation is due to coincidence or force majeure.

For the specific cancellation and modification fees, please refer to the specific conditions attached to your fare.

Getflights BV charges a fixed administration fee in case of change and/or cancellation.

 

5. Personal data

In accordance with the provisions of the European privacy legislation (GDPR) on the protection of privacy in relation to the processing of personal data:
 

Personal identification data will be processed by Getflights BV for the purpose of providing the services for which the customer has registered with Getflights BV. In addition, Getflights BV will also use these data to offer the customer information on other Getflights BV products and services that may be of interest to the customer. 
 

Getflights BV will only use the customer's personal data for the above-mentioned purposes. Getflights BV will not disclose, sell, rent or exchange personal data with other organisations or entities except to companies acting as data processors and acting on behalf of and under the control of Getflights BV. It may also be done if you have been notified in advance and expressly agree to this, or if otherwise required by law. The customer has the right to access, limit and, if necessary, request rectification of erroneous data. The customer may also object to the future processing of his personal data for direct marketing purposes. This can be done simply by emailing hello@groupflights.com or writing to Getflights BV, Gistelsesteenweg 676, 8200 Bruges. With every electronic newsletter, customers are offered the opportunity to unsubscribe.

 

6. Choice of forum

For any disputes, only the Courts of the district of Ghent, Bruges section are competent.


 




 

Special Terms and Conditions Getflights BV as tour operator

In the very exceptional situation that Getflights BV acts as travel organiser cfr. the Package Travel Act of 21 November 2017, the General Terms and Conditions of the Travel Disputes Committee apply, which you can find here

The special conditions below take precedence over these General Terms and Conditions:
 

1. Agreement

The traveller confirms to have taken note of the pre-contractual information for a package holiday, stipulated in article 5 of the Package Travel Act, for coupled travel arrangements, article 66 of the same Act, and for separate travel services article 71 of the same Act. Also the information who is liable for the proper performance of the travel commitments, and who guarantees the legally imposed security in case of insolvency and the body providing it, being Travel Guarantee Fund.

 

2. Payment of the travel sum

Advance

When registering a trip, an advance of at least 30% must be paid immediately, with a minimum of EUR 150 per person, unless otherwise agreed on the order form/tour confirmation/invoice. When registering within the month before departure, the full travel sum must be paid immediately, upon confirmation of the agreement
 

Balance

Unless otherwise agreed on the order form/travel confirmation/invoice, the traveller must pay the balance no later than 6 weeks before departure, after which the travel documents will be delivered to him no later than 1 week before departure.


Non-payment

In case of non-payment of all or part of the price, the provisions of Book XIX of the Economic Law Code apply, and Getflights BV will send the customer a free reminder to pay the amount due within 14 calendar days. If the traveller does not pay within that period, the outstanding amount shall be increased by an annual interest calculated at the reference interest rate increased by eight percentage points referred to in Article 5, second paragraph, of the Law of 2 August 2002 on combating late payment in commercial transactions calculated from the calendar day following the day on which the free reminder was sent to the customer, as well as by a lump-sum compensation of:

  • 20 euro if the balance due is less than or equal to 150 euro;
  • 30 euro plus 10 % of the amount due on the tranche between 150,01 and 500 euro if the balance due is between 150.01 and 500 euro;
  • 65 euro plus 5 % of the amount due on the tranche above 500 euro up to a maximum of 2000 euro if the balance due is above 500 euro.

 

3. Cancellation and changes to the agreement by the traveller/organiser
 

If a traveller cancels the trip, this should be reported to Getflights BV via durable data carrier, and in clear terms, with as cancellation date, the date on which the written cancellation was received. Depending on the moment of cancellation, the following fees apply. When cancelling tickets, 100% compensation will always be charged, regardless of the cancellation date.

With regard to other travel services, the following cancellation fees apply

  • More than 90 days before the departure date: 25% of the total travel sum
  • From 90 to 61 days before the departure date: 50% of the total travel sum
  • From 60 to 45 days before the departure date: 75% of the total travel sum
  • From 44 days before the departure date: 100% of the total travel sum (idem in case of no-show at departure)

The traveller is reminded that - in the case of a package holiday - according to art 30 of the Package Travel Act, prior to departure he is entitled to cancel the trip without owing any compensation for cancellation, if unavoidable and extraordinary circumstances occur at the destination or in the immediate vicinity thereof which have a significant impact on the implementation of the package holiday or which have a significant impact on passenger transport to the destination. In such a case, the passenger shall be entitled to a full refund of all sums paid for the package holiday, but not to compensation. Changes to a booked trip may be accepted if possible, but in addition to the change fee imposed by the supplier, a cost and administrative fee will be charged:

  • More than 60 days before departure: a minimum of 150 euro per traveller;
  • Less than 60 days before departure: minimum 250 euro per traveller.
